Does Louboutin Own The Shade Red?

In New York a judge says, designer Christian Louboutin may not have the right to own the trademark for the shade red for his signature soles. 

Louboutin own the red sole now, but wants to continue the same trademark rights as Tiffany's(who own their signature blue) and UPS(who owns brown).

The judge says, it's different for fashion and colors are used broadly and the full color palette must to be used to create.
